CBA's Women in Banking Keynote Speaker Jana Schmidt Named CEO of Harland Clarke

Fed’s Bowman: Agencies Have Obligation to Community Banks
At a recent conference in San Diego, CA, Federal Reserve Governor Michelle “Miki” Bowman said regulators have an obligation to tailor their regulations to the smaller size and less-complex risk profiles of community banks.
 
“If we keep our focus on appropriately tailoring regulatory requirements for community banks so they may continue to prudently thrive, then community bankers should be able to devote more resources and time to serving their customers and communities,” she said. 
Bowman said she plans to travel widely and listen to community bankers and other stakeholders as the first person to fill the Fed’s community banking seat. “I will take back the knowledge I gain from these discussions and use it to improve our work,” she said. Read Bowman's speech.

Otting Backs CFPB Small-Dollar Plan
Comptroller of the Currency Joseph Otting said he supports the Consumer Financial Protection Bureau’s proposal to rescind certain provisions of its rule on payday, vehicle title and certain high-cost installment loans. The CFPB would drop the rule’s requirements that lenders make certain underwriting determinations before issuing such loans. Otting said the proposal will allow responsible lenders to compete in the small-dollar market. Read Otting’s statement. Read CFPB proposal.

Agencies Issue New Rule Covering Private Flood Insurance
Five federal regulatory agencies issued a joint final rule to implement provisions of the Biggert-Waters Flood Insurance Reform Act of 2012 requiring regulated institutions to accept certain private flood insurance policies in addition to National Flood Insurance Program policies. The rule, which takes effect July 1, 2019:
  • Implements the Biggert-Waters Act requirement that regulated lending institutions accept private flood insurance policies that satisfy criteria specified in the Act;
  • Allows institutions to rely on an insurer’s written assurances in a private flood insurance policy stating the criteria are met;
  • Clarifies that institutions may, under certain conditions, accept private flood insurance policies that do not meet the Biggert-Waters Act criteria; and
  • Allows institutions to accept certain flood coverage plans provided by mutual aid societies, subject to agency approval.

Agencies Propose Community Bank Leverage Ratio Rulemaking
Federal agencies are issuing a notice of proposed rulemaking that would provide a simplified measure of capital adequacy for qualifying community banking organizations consistent with section 201 of the Economic Growth, Regulatory Relief, and Consumer Protection Act. Qualifying community banking organizations that comply with and elect to use the community bank leverage ratio (CBLR) framework and that maintain a CBLR greater than 9 percent would be considered to have met the capital requirements for the “well-capitalized” capital category under the agencies’ prompt corrective action (PCA) frameworks and would no longer be subject to the generally applicable capital rule. Special Mortgage Program for Rural Homeowners
CBA Associate Member Crescent Mortgage Company recently announced an opportunity to help borrowers purchase or refinance a home in areas designated as rural across the country. For loan applications where the property is in a FHFA designated rural county, and the borrower(s) combined income is below the area median income (AMI) for that county, Crescent will pay up to $2,000 Community Cash in the form of a credit towards their Mortgage Insurance or Interest Rate. Senate Banking Chair to Speak at ICBA Capital Summit
Senate Banking Committee Chairman Mike Crapo (R-Idaho) has been confirmed as a guest speaker for the 2019 ICBA Capital Summit in Washington. The champion of the S. 2155 regulatory relief law will address community bankers at the industry’s premier grassroots advocacy event, which is slated for April 28 - May 1 in the nation’s capital. Click here to learn more and register for the summit.

Ag Leader: Consider Expected Dairy Payments as Collateral
Senate Agriculture Committee Ranking Member Debbie Stabenow (D-Mich.) urged regulators to clarify that lenders may account for dairy program improvements under the new farm bill as they extend credit to dairy farmers around the country. She also urged lenders to consider expected payments under the new program when making loans to dairy farmers, even though the government shutdown has delayed operation of that program. Program benefits will be retroactive to January 1, according to the USDA. Read more from Stabenow.

Phishing Campaign Targets Compliance Officers
A phishing campaign recently targeted anti-money-laundering contacts at banks and credit unions, according to security blogger Brian Krebs. The KrebsOnSecurity post covers the January 30 series of emails that contained malware, addressed contacts by name, and were disguised to look like they came from BSA-AML officers at other financial institutions. The contact information used by fraudsters indicate a possible breach of BSA contact data. Read the report.

OCC Names New Supervision Deputy
The OCC said Grovetta Gardineer will become its senior deputy comptroller for bank supervision policy upon the retirement of Grace Dailey on March 2. Gardineer will direct the formulation of policies and procedures for supervising and examining national banks and federal savings associations. She is the current senior deputy comptroller for compliance and community affairs and has more than 31 years of experience in banking policy. Read more from the OCC.

FNBCC Staff Volunteer for Night to Shine
Staff from First National Bank of Coffee County, Douglas, volunteered at the 2019 Night to Shine event held last Friday at Coffee Middle School. The night was hosted by First Baptist Church & GracePointe Church in Douglas, and sponsored by The Tim Tebow Foundation. The event was a prom night experience for people with special needs ages 14 and older, celebrated simultaneously with hundreds of other locations across the world.
