FS-ISAC Outlines Agency Cybersecurity Warning
FS-ISAC’s latest risk summary spotlights the federal banking agencies’ alert advising financial institutions to actively manage the risks associated with interbank messaging and wholesale payment networks. That joint statement notes recent cyber-attacks have targeted these systems to originate unauthorized transactions. The FS-ISAC report also highlights recent risks to community financial institutions, including an Android bulletin on vulnerabilities to Android devices following a recent security update. Fintech Firms Press OCC for Specialized Charter
Fintech companies are asking a federal regulator to create a specialized charter that would allow them to comply with federal rules instead of facing a state-by-state licensing framework. In comment letters to the Office of the Comptroller of the Currency, the Chamber of Digital Commerce is seeking a "fintech or 'bank-light' charter," while the Innovative Lending Platform Association (ILPA) envisioned a licensing system to "prevent [the] application of an inefficient and duplicative patchwork of state and federal laws."
ILPA members Kabbage, OnDeck and CAN Capital were seconded by the Center for Financial Services Innovation, the Milken Institute and Coin Center, which all called for a nonbank charter or variations of one. ICBA Backs Bills to Nullify Overtime Final Rule
ICBA expressed its strong support for legislation to effectively nullify the Labor Department’s overtime final rule. The Protecting Workplace Advancement and Opportunity Act (S. 2707 and H.R. 4773) would bar the department from issuing a similar rule without first analyzing its impact on all employment sectors. The legislation, introduced in the Senate by Sens. Tim Scott (R-S.C.) and Lamar Alexander (R-Tenn.) and in the House by Rep. Tim Walberg (R-Mich.), would require the analysis to include hard-dollar and non-financial costs. In letters of support for the bills, ICBA said the rule will significantly restrict exemptions under the Fair Labor Standards Act for administrators, executives and sales-commissioned staff.
The Labor Department last month issued a final rule extending overtime pay to roughly 4.2 million additional workers. The rule increases the salary tests used to exempt employees from overtime pay and permanently indexes the thresholds for inflation. While the department reduced the salary threshold from its proposed rule, banking leaders continue to have serious concerns with the rule’s impact on employee benefits and hiring.

The House Appropriations Committee approved a bill Thursday that would subject the Consumer Financial Protection Bureau to the appropriations process, among other things. The bill is mostly focused on providing $21.7 billion in funding for the Treasury Department and the Securities and Exchange Commission, which represents a $1.5 billion decline from 2016 levels and $2.7 billion less than what President Obama requested.
But banks are closely watching changes the bill would make to the CFPB, including moving it from a single director to a five-person commission and requiring the agency to revisit recent payday and arbitration rulemakings. One of the amendments to the bill would deny funding for the CFPB's payday lending proposal until the bureau conducts a study of the populations most reliant on nonbank lenders and identifies products that could fill the void of the estimated 60%-70% decline in payday loan volume. Heritage Community Foundation Gives Back
The Heritage Community Foundation recently presented a grant to Kaye Sheets, Executive Director, and Sandy Craig, Board Member, of Samaritans Together of Henry County, Inc. The $2,500 grant will be used to purchase a new computer server. The mission of Samaritans Together of Henry County, Inc. is to provide rent and/or utility assistance to the needy people of Henry County.

Vets Connect in Henry County provides the support and services that homeless veterans need to secure permanent housing, and on a path to the American dream.

Board Members of the Heritage Community Foundation introduced Vanessa Wilkins, Executive Director, Promise Place to David and Linda Clark, owners of C&C Fence Company in McDonough. C&C Fence Company, a Heritage Community Foundation Partner, is providing Promise Place with a sliding gate, call box, and gate security system for its shelter. The mission of Promise Place is to prevent domestic violence and provide safe environments for victims and their families.
