Advocacy Update,

Dead Issues Find New Life 

Friday, March 6 was Crossover Day.  It was a late night under the Gold Dome, especially in the House, where Speaker Jon Burns and his fellow representatives worked past midnight to advance House priorities.  While the frenzy of Crossover has subsided, a new source of agitation has emerged: dead policy issues finding new life at a moment's notice.  This dynamic was on full display this week during the Senate’s debate on HB 945 (see below). 

As is typical in the closing weeks of the session, bills are hijacked, gutted, and loaded with new language to resurrect otherwise lifeless legislation.  It doesn’t matter if the bill was active last week, last year, or never vetted as a standalone bill at all—lawmakers are determined to move their priorities to the Governor’s desk one way or another.  With the 2026 elections looming, members are eager to secure policy wins and campaign talking points before the session concludes. 

As a result, each amended measure must be carefully screened, and the status of key issues can shift rapidly.  With fewer than ten legislative days remaining in the 2026 session, the pace and unpredictability will only increase. 


Department of Banking Housekeeping Bill 

Department of Banking Housekeeping (HB 945)  
Rep. Bruce Williamson, R-Monroe
Adopted by the Senate on March 10 

On March 10, the Senate took up HB 945, the Department’s annual housekeeping package.  This legislation is drafted in the early fall, reviewed by the Governor’s office in early winter, and is typically one of the first bills to land on the Governor’s Desk.  As department legislation, it’s somewhat sacrosanct; amendments and floor mischief rarely touch it. 

Not so this year.  After Sen. Mike Hodges finished his presentation, Sen. Blake Tillery offered an amendment to add debanking language from SB 57.  It prohibits discrimination in the provision of essential services, which is defined as financial or utility services.  “Financial institution” is a bank or credit union that has more than $2 billion in assets or any affiliate or subsidiary of such bank or credit union.  Last year, that bill failed in the same chamber by a vote of 13-43. 

Senators offered three other amendments that would tweak elements of the Tillery amendment.  Two of these amendments increased the asset threshold under the definition of financial services.  Sen. Hodges and Chairman Carden Summers urged their colleagues to protect the important work done by Commissioner Bo Fears and his team at the Department and pass the bill without amendment. 

After a prolonged debate, the Tillery amendment failed by a vote of 6-41.  Click here to see the vote counts.    Ultimately, HB 945 passed unanimously and is now eligible for enactment by the Governor.

Commerce and Trade (HB 1112)

Adopted by the House on March 6 and assigned to the Senate Finance Committee on March 9  

HB 1112 provides for rounding of the total price of the sale of goods or services when using cash.  After concerns around ambiguity, it makes clear that exact-change cash payments remain acceptable.  

 

Boat Titling (HB 115)  
Rep. Jesse Petrea, R-Savannah
Adopted by the Senate on March 10 

HB 115 pertains to the registration, operation, and sale of watercraft.  It authorizes the Department of Natural Resources to remove, store, and dispose of abandoned vessels.  The bill is now eligible for consideration by the Governor. 

 

Transactional Gold and Silver Act (SB 424)  
Sen. Marty Harbin, R-Tyrone
Adopted by the Senate on March 6 and assigned to the House Banks and Banking Committee on March 9  

SB 424 provides for gold and silver specie as legal tender.  It creates an electronic payment system and a bullion depository.  It prohibits a social credit scoring system. 

 

Medical Cannabis (SB 220)

Adopted by the House on March 12 

SB 220 renames low THC oil as medical cannabis and also adds language about parents and caregivers.  The bill returns to the Senate for further consideration. 

 

Local Government Investment Pool (SB 441)  
Sen. Marty Harbin, R-Tyrone
Favorably reported by the House Budget and Fiscal Affairs Oversight Committee on March 12 

SB 441 requires certain pooled investments to be approved by the State Depository Board. 

 

Financial Literacy (HB 1114)  
Rep. Bill Yearta, R-Sylvester
Adopted by the House on March 6 and assigned to the Senate Education and Youth Committee on March 9  

HB 1114 allows students in ninth and tenth grade to complete the high school graduation financial literacy course requirement.

Notice of Assessment (HB 275)

HB 275 provides for the acceptance of tax digests in the event of a publication error made by a newspaper.  It revises the required information for bills and notices of assessment for ad valorem tax of property.  In addition, it repeals a provision relating to the annual calculation and certification of estimated roll-back rate. 

 

Bona Fide Conservation Use Property (HB 547)

Adopted by the House on March 6 and assigned to the Senate Finance Committee on March 9 

HB 547 permits the combination of multiple bona fide conservation use covenants of a single owner into a single, new, ten-year covenant. 

 

Georgia Taxpayer Privacy Protection Act (HB 874)
Rep. David Huddleston, R—Roopville 
Adopted by the House on March 6 and assigned to the Senate Finance Committee on March 9  

HB 874 prohibits the disclosure of taxpayer telephone numbers in property tax records sold, transferred, or shared with third parties. 

 

Affordable Housing Construction Materials (HB 1132)

Adopted by the House on March 6 and assigned to the Senate Finance Committee on March 9  

HB 1132 exempts from state and local sales and use taxation materials used in the construction, renovation, and rehabilitation of affordable housing by purely public charities. 

 

Repossessors of Motor Vehicles (HB 1134)

Assigned to the Senate Banking and Financial Institutions Committee on March 6 

HB 1134 revises the notice requirements for repossessors of motor vehicles.

Manufactured Homes (HB 165)
Rep. Lehman Franklin, R—Brooklet 
Favorably reported by the Senate Finance Committee on March 9 

Last year, the original provisions of HB 165 were enacted under a different bill number.  This week, the Senate Finance Committee used HB 165 as a vehicle to advance provisions from HB 134.  It subjects 50% of the manufacturer's invoice amount to sales tax on the first retail sale or retail purchase of a manufactured home.  All other sales are tax-exempt.  The bill sunsets on June 30, 2030.   

 

Income Tax Reduction (HB 880)
Rep. Shaw Blackmon, R—Bonaire
Adopted by the House on March 6 and assigned to the Senate Finance Committee on March 9 

HB 880 reduces the income tax rate that may be reached under certain conditions. 

 

Eliminate Ad Valorem Tax on Timber (HR 1000)  
Rep. Chuck Efstration, R-Mulberry
Adopted by the House on March 6 and assigned to the Senate Finance Committee on March 9  

HR 1000 proposes an amendment to the Constitution to eliminate the ad valorem tax assessment of certain timber at sale or harvest.  To make affected cities, counties, and school districts whole, the state will annually appropriate funding according to a formula. 

 

Property Tax Reform (HB 1116)  
Rep. Shaw Blackmon, R-Bonaire
Adopted by the House on March 6 and assigned to the Senate Finance Committee 

The Georgia HOME Act shifts a portion of local government funding away from property taxes and toward local sales taxes.  Beginning in 2028, local governments may not increase property tax revenue beyond 3% or the rate of inflation, whichever is greater.  The cap applies to total property tax revenue, including both homesteaded and non-homesteaded property.  This revenue cap can be waived by a local referendum or local act approved by the General Assembly. 

Related legislation (HR 1114) was voted down by the House on March 3.  It proposed amending the constitution to achieve property tax reform, which requires 120 votes; HR 1114 received just 99.  In response, Speaker Jon Burns and the Republican caucus shifted strategy, moving forward with general legislation (HB 1116), which only requires a simple majority to pass. 

 

Bona Fide Conservation Use Property (SB 306)

SB 306 requires notices of impending expiration of preferential assessment for bona fide conservation use property and bona fide residential transitional property be sent via certified mail. 

 

Deny Tax Credits for Businesses that Hire Illegal Aliens (SB 465)

Adopted by the Senate on March 6 and Assigned to the House Ways & Means Committee on March 9  

SB 465 disqualifies business enterprises that hire illegal aliens for large-scale projects from claiming certain tax credits associated with such projects.

First Offender Offenses (HB 162)

HB 162 provides for the restriction and seal of First Offender Act sentences until such status is revoked.  It also provides for the restriction and seal of first offender sentences at the time of sentencing. 

 

Magistrate Court Fees and Costs (HB 999)  
Rep. Rob Leverett, R-Elberton
Favorably reported by the Senate Judiciary Committee on March 9  

This legislation clarifies fees and costs associated with Magistrate Court proceedings.  It also corrects a drafting error from a previous bill related to the nonpartisan election of magistrates. 

  

Statewide Grand Juries (SR 875)

Voted down in the Senate on March 6 

SR 875 proposed a constitutional amendment to provide for a statewide grand jury.

Tax Credit for Individuals (HB 1000)

Favorably reported by the Senate Finance Committee on March 9  

HB 1000 provides a one-time tax credit for individual taxpayers who filed income tax returns for the 2024 and 2025 taxable years.  This measure is a key component of Governor Kemp’s final legislative package. 

 

Georgia Bureaucratic Deference Elimination Act (HB 1247)

Adopted by the House on March 4 and assigned to the Senate Judiciary Committee on March 6 

HB 1247 prohibits courts and administrative officers from deferring to agency interpretations of laws and regulations. 

 

Centralized Regulation (HB 1254)

Adopted by the House on March 6 and assigned to the Senate Regulated Industries Committee on March 9  

HB 1254 moves the regulation of various professions from individual boards to the Secretary of State. 

 

Abusive Website Access Litigation (HB 1470)
Rep. Trey Kelley, R—Cedartown
Adopted by the House on March 6 and assigned to the Senate Judiciary Committee on March 9  

HB 1470 creates a new cause of action for "abusive website access litigation" targeting lawsuits alleging that a Georgia-based business's website violates accessibility requirements under the Americans with Disabilities Act (ADA) or similar state/federal laws. 

 

Temporary Door Locking Devices (SB 454)  
Sen. Rick Williams, R-Milledgeville
Adopted by the Senate on March 6 and favorably report by the House Public Safety and Homeland Security Committee on March 11  

SB 454 authorizes the use of temporary door locking devices in public buildings during certain emergency situations.  It also contains language from HB 1327 regarding key lockboxes at certain schools. 

 

Transparency in Foreign Funded Political Activities (SB 177)
Sen. Jason Anavitarte, R—Dallas 
Pending in the House Rules Committee 

SB 177 provides for transparency in foreign-funded political activities within the state.  It requires agents of hostile foreign principals and foreign-supported political organizations to register with the State Ethics Commission.   It was scheduled for a vote in the House on March 12 but was sent back to the Rules Committee.
